Terms of sale

This is a translation for your convenience. In case of a dispute, the Serbian version applies.

These terms apply to every purchase on powernutz.rs and are an integral part of the sales contract between the seller and the buyer. By confirming the order, the buyer declares that they have read and accept them.

Under the Law on Consumer Protection (Official Gazette of the Republic of Serbia, No. 88/2021), buying through the site is a distance sale. The Law on Trade, the Law on Electronic Commerce and the Law on Obligations of the Republic of Serbia also apply.

2. Products

The site sells PowerNutz mixes of nuts and fruit, individually and in packs. Photos are for illustration only, so the packaging and colors may differ slightly from what is shown, and this is not considered a product defect.

Allergens: the products contain peanuts and tree nuts, and some also contain milk and soy. The exact ingredients, allergens, nutrition facts and shelf life are listed on the label of each pack. Read the label before eating.

We do our best to keep descriptions and prices accurate. If an obvious error in a price or a description still slips onto the site, the seller may cancel the order and lets the buyer know right away.

3. Ordering

  • The buyer puts products in the cart, enters the delivery details at checkout and confirms the order with the “Place order” button. Before confirming, the buyer sees all the products, the delivery cost and the total.
  • After the order, a confirmation with the order number and a summary of what was ordered arrives at the email address entered.
  • The sales contract is concluded when the seller confirms the order, on screen after the order is sent and by email. If a product is out of stock, the seller may cancel the order and lets the buyer know right away.
  • The buyer may cancel the order free of charge as long as the package has not been handed over to the courier service, by writing to contact@powernutz.rs or calling +381 64 284 5711.
  • The buyer is responsible for the accuracy of the details they enter. Only adults may buy.
  • Using the site and contacting the seller (email, phone) carry no extra costs other than those the buyer's own phone or internet provider charges.

4. Prices

All prices are in Serbian dinars (RSD), include VAT and are final for the buyer. There are no hidden costs, and the delivery cost is shown separately before the order is confirmed. The price shown on the site at the time of the order applies. The seller may change prices and run promotions, but a change does not affect orders that are already confirmed. Discount codes are valid under the conditions they were issued with and cannot be exchanged for cash.

5. Payment and delivery

Payment is in cash to the courier when the package is received (cash on delivery). Delivery is carried out by the courier service AKS Express to addresses in the Republic of Serbia. Delivery costs 390 RSD and is free for orders of 2.000 RSD or more. Delivery usually takes 1 to 3 business days from the order, and no longer than 30 days.

Until the package is handed over to the buyer, the seller bears the risk of damage to or loss of the goods. If the courier cannot deliver the package even on the second attempt for reasons on the buyer's side, or the buyer refuses to accept it without a good reason, the package goes back to the seller. The seller then lets the buyer know that the sales contract has been terminated and charges them the delivery costs. The details are on the Delivery and payment page.

6. Right of withdrawal

A buyer who is a consumer has the right to withdraw from a distance contract within 14 days, without giving a reason. The period runs from the day the package was received by the buyer or by a person they named, other than the courier. It is enough to send a withdrawal statement within that period to contact@powernutz.rs or by post to the seller's address. The statement takes effect on the day it was sent.

Since the products are food in sealed packaging, only unopened and undamaged packs can be returned, for health and hygiene reasons. By law, the right of withdrawal does not apply to pouches opened after delivery.

The buyer returns the goods at their own expense within 14 days of sending the statement. The seller refunds the amount paid, including the cost of the original delivery, no later than 14 days after receiving the statement, and may hold back the refund until the goods arrive or until the buyer sends proof that they were sent. Money is refunded only by transfer to the buyer's bank account in dinars (RSD). The statement form and the full procedure are on the Complaints and returns page.

7. Conformity and complaints

The seller delivers goods that match the description on the site and the label. If a product is damaged, wrong or has another defect, the buyer has the right to make a complaint and may ask for a replacement, a price reduction or termination of the contract with a refund. If the wrong product was delivered, the buyer gets the product they ordered or a full refund, and the seller pays for the return.

The seller confirms receipt of the complaint and gives the number it was registered under, replies within 8 days of receiving it and resolves it within 15 days of the day it was made. The procedure is described on the Complaints and returns page.

8. Data protection

The seller uses the details the buyer leaves when ordering only to deliver the order and meet legal obligations. The details are in the Privacy policy.

9. Dispute resolution

The seller and the buyer will try to settle any disagreement by agreement. The consumer can also start out-of-court consumer dispute resolution before a body on the list kept by the ministry responsible for trade. If the seller rejects a complaint, it tells the buyer about this option in its reply. If no agreement is reached, a competent court in the Republic of Serbia decides, in accordance with the law.

10. Changes to these terms

The seller may change these terms. An order is governed by the terms that were in force when it was sent.
